Final Notification of Regularization of Contract Employees in BPS-01 to 15 Working in Local Govt

Govt of the Punjab, Local Govt & Community Development Department has issued Notification No. SO.Admn.II (LG)Misc-2012 (P) dated 4th September 2013 in connection with the regularization of contract employees of BPS-01 to BPS-15 who were working on contract basis.

In this notification, the copy of Notification No. DS (O&M) (S&GAD) 5-3/2013 dated 01-03-2013 and circular dated 19-08-2013 have been forwarded to all the DCO of Punjab, all the Administrative Tehsil/Town Municipal Administrative of Punjab and the Tehsil/Town Municipal Officers in Punjab.  It has been decided that to adopt the said Notification/Circular letter mutatis mutandis to regularize the services of contract employees from BPS-01 to BPS-15 of Local Councils on the same terms and conditions as mentioned in the same notification/circular.

The additional financial liability will be born by the respective local governments and no supplementary grants would be given on this account.

Govt of the Punjab Finance Department has issued Notification No. FD-SR-II/2-141/2012 dated 9th September 2013 in connection with the Leave Encashment for 365 days instead of 180 days. Earlier the benefit of leave encashment for 180 days was granted to the employee who retired on Leave Encashment basis and now the employees retiring on leave encashment bases would get the benefit of 365 days leaves.

Federal Govt of Pakistan has already issued the Notification of Leave Encashment for 365 days and now the Punjab Govt has also adopted the Notification No. S.R.O.70 (KE)/2012 dated 29th August 2012 issued by Finance Division Regulation Wing Islamabad. Office of the District Co-ordinate Officer, City District Lahore has already issued the Order No. BA/Acctt/21425 dated 03-12-2012 in connection with the rates of daily wages for labour and monthly emoluments for the part time employees. These rates had been fixed for the Lahore District wef 01-08-2012. The detail of these rates is as under:

Upper Age Relaxation for Ex-Defence Forces Officers/Personals

Govt of the Punjab Services & General Administration Department has already issued the Notification No. SORI (S&GAD) 9-1/2000 (P-I) dated 11th September 2004 in connection with the Upper Age Relaxation for Ex-Defence Forces Officers/Officials.

In exercise of the powers conferred upon him under Section 23 of the Punjab Civil Servants Acts 1974 (VIII of 1974) the Governor of the Punjab is pleased to direct that in the Punjab Civil Servants Recruitment (Relaxation of Upper Age Limit) Rules, the following further amendment may please me made:

In Rule 3, clause (iii) shall be substituted by the following:

“(iii) In the case of Ex-Defence Forces Officers/Personal, the entire period of service rendered by them in Defence Forces, subject to a maximum of 10 years, shall, for the purposes of upper age limit for appointment under any rule, be excluded from their ages.”

Provision of Documents Regarding Promotion of SSTs as SS

The Director (Admn-Male) for Director Public Instruction (SE) Punjab Lahore has submitted a circular No. 7472/AD(C-I) dated 11th September 2013 to all the District Education Officers, Punjab (SE) to provide the following information/documents of each SST for promotion as SS within the targeted date i.e 25-09-2013. After this date no case of promotion will be considered and the concerned SST as well as the DEO will be held responsible in this regard and no excuse will be accepted. The detail is shown in the picture/circular in connection with the subject case.

All the SSTs may be directed to provide their complete data on the prescribed promotion proforma duly countersigned by the concerned Head of the Institution as well as DEO (SE), concerned.

At the time of preparation of working paper, the cases out of the above will be considered as per availability of posts and issuance of this letter will not be claimed as a right of promotion. The full detail on this matter is shown in the letter.

Notification of Enhancement of Upper Wages Ceiling by Sindh Govt

Govt of the Sindh, Labour & Human Resources Department has issued Notification No. L.II-(SESSI)-5-12-91 dated 28th October 2013 in connection with the Enhancement of the Upper Wages Ceiling from Rs. 10,000/- to Rs. 15,000/- PM.

According to the Notification, With the approval of the Competent Authority (Chief Minister Sindh) and in exercise of the powers conferred under Section 71 of the Provincial Employees Social Security Ordinance 1965, Government of Sindh has reviewed the wages limits specified in clause (f) of Sub-Section 8 of Section 2 of the Ordinance ibid and recommended Enhancement of the Upper Wages Ceiling from Rs. 10,000/- to Rs. 15,000/- per month.

Therefore in exercise of the powers conferred under Section 71 of the Provincial Employees Social Security Ordinance 1965, it is hereby notified that the monthly wages ceiling enhanced from Rs. 10000/- PM to Rs. 15000/- PM or from Rs. 400/- per day to Rs. 600/- per day for the purpose of levy of contribution, as envisaged under Section-2(8)(f) of the Ordinance ibid. Special Quota Educational Scholarships have been announced by PEEF. All those students who have got minimum 60% marks in the Annual Exam 2013 (Matric/SSC) and the monthly income of their parents is equal or less than Rs. 15,000/- per month and the belong to any one following categories can apply for the Punjab Educational Endowment Fund Special Quota Educational Scholarships.

Computer Allowance to SST (Computer Science)-Decision of Mohtsib Punjab

The Mohtsib Punjab on 12-11-2013 has ordered the District Accounts Officer, Jhang to allow the Computer Allowance to Mr. Muhammad Khalil-ur-Rehman SST (Computer Science), Govt High School, Ashaba, District Jhang.

The complainant is working in Education Department District Jhang as SST Computer Science. According to the complainant Computer Allowance is being granted in other districts of Punjab to the Computer Science Teachers but in the District Jhang they are deprived of their this right.

The Mohtsib Punjab instructed Secretary Finance that they should adopt the uniform policy in all the districts regarding this matter. This decision has been given in keeping in view the grant of Computer Allowance to SSTs (Computer Science) District Rahim Yar Khan.

Study Leave Notification of 2009 by School Education Department Punjab

Govt of the Punjab School Education Department has already issued Notification No. SO (SE-III) Misc/09 (Study Leave) dated 11th December 2009 in connection with the Study Leave for the Punjab Govt School Teachers. Later on there has been made amendment in study leave vide Notification No. SO (SE-III)Misc/09/Study Leave) dated 21st October 2013.

The purpose of study leave is to provide an opportunity to the teachers to make them professional and skill in their school subject whereas it has been observed that a number of cases during the year have been received where teachers like PST and EST (all categories) have got admission in M.Sc /Diploma in Health & Physical Education which is irrelevant to their job/assignments. This sort of practice is contrary to the Study Leave Rules/Policy which is as under:

a-      Study Leave may be granted as additional leave to Government Servants for the study of scientific, technical or similar problems or in order to undertake special course of instructions.

b-      Study Leave should be granted with due regard to the exigencies of the public service.

It has been noticed that Government Universities/Institutions are being ignored and private (affiliated) universities/institutions located out of province are being selected for study by the teachers.

The competent authority has taken a serious notice of the above said situation and has been pleased to direct as under:

i-                    The admission in universities/institutions out of province will not be allowed if such facilities are available in the province.

ii-                  No departmental permission should be granted other than the school subject particularly in professional training course.

iii-                The admission in the campus constituted by the various universities in various cities as Distance Learning Centers may not be allowed.

iv-                Departmental Permission in each case may invariably be sought well before the submission of the admission form to the University/College otherwise study leave will not be sanctioned.

v-                  The permission case will only be forwarded by the concerned appointing/controlling authorities in shape of a letter with Number & Date and copy to the study leave sanctioned authority.

vi-                Prior to sanction of any kind of leave by the competent authority, the teacher will not be relieved from station.

vii-              In case of any violence of these instructions, the officer forwarding the study leave case will personally be responsible for the consequences.

Notification of Regularization of Contract Employees of TMA Sargodha wef 1st March 2013

Office of the District Coordination Office, District Govt Sargodha has issued order No. 1619/EB dated 18th November 2013 in connection with the regularization of Contract Employees working in TMA Sargodha.

The service period of contract shall not be counted for any purpose (Pension, gratuity, leave etc) on his appointment under the Punjab Civil Servants Rules-1974 and the rules framed thereunder. The salary component shall be in accordance with the pay scales plus the usual allowances prescribed for the post against which they are being appointed. They will however not entitled to the payment of 30% social security benefits in lieu of pension or any other pay package being drawn by them.

Pay of the contract employees being appointed in basic pay scales shall be fixed at the initial of the respective pay scales and the increments already earned during the contract period shall not be converted into personal allowance.

Advance Increments & M.Phil Allowance to Graduate English Teachers

Govt of the Punjab School Education Department has issued orders No. SO(SE-III)7-241/2013 dated 5th November 2013 in connection with the matter of Advance Increments & M.Phil Allowance to Graduate English Teachers. The detail is as under: 

  1. The    W. P    NO. 11269/3013 filed by Mr. Muhammad Shabbir, EST (English) Govt Elementary School lshaq Wala Muzaffargarh  and 04 others was disposed of by the honourable Lahore High Court;  Multan Bench; Multan with the direction to the respondent NO.1;  Secretary School Education to decide petitioners case in the light of judgment rendered by this court in writ petition NO.8395OF2012.
  2. The operation paragraph of judgment dated 07.11.2012 passed in with petition NO.8395/2012 is produced as under:“It  is an establish principle of law that once an Appex court decides some point of law that is applicable on all similarly placed persons. The respondents are not denying this fact but their defence is that the petitioner is hit by article 212 of the constitution of Islamic Republic of Pakistan. The argument of learned assistant advocate general; Punjab is of no use. As the petitioners are claiming the benefit of judgment of the honorable Supreme Court of Pakistan as they are on similarly placed position like the appellants of judgment passed by the learned Punjab Service Tribunal. In view of the above,  this petition is allowed and the petitioner case is declared at per with the case of the appellants of judgment passed by the learned Punjab Service Tribunal dated 04.10.2010.”
  3. The judgment dated 04.10.2010 passed in appeal  NO.1545/2010 is produced as under:                                                                                                             “The perusal of above noted notification issued by the govt. of Punjab Finance Department on 07.07.2007 leaves no room for doubt that despite discontinuity of the above noted concession/grant of increment w.e.f 01.12.2001;  all those officer/officials who had acquired higher qualification prior to 01.12.2001 were already entitled to get the benefit of advance increments if otherwise eligible under the policy; meaning there by that the relevant date for acquiring higher education during service for getting the relief under 1983 notification was that the same should have been acquired prior to 01.12.2001; therefore were entitled to claim benefit of para-15 (iii) of notification dated 25.08.1983. Resultantly all these appeals are allowed and the appellant are declared eligible for grant of increments under notification dated 25.08.1983 provided they have earlier not availed the said concession in respect thereto .”
  4. The judgment dated 07.11.2012 passed in writ petition NO. 8395/2012 upheld by the  honorable Supreme Court of Pakistan vide judgment dated 07.03.2013 was submitted to the Finance Department for necessary advise the department to implement the judgment to the extent of petitioners only.  Accordingly the petitioners in writ petition No. 8395/2012 were allowed advance increments on acquiring higher qualification of M.A, M.Ed etc.
  5.    In compliance to the court’s order following steps were taken:-

a). The  petitioners were afforded personal hearing and heard at length in the presence of Mr. Riaz Hussain Qureshi, litigation officer O/O EDO (Edu) Muzaffargarh;

            b). The available record was perused and following facts are observed:-                  i.  The Graduate English Teachers were recruited on contract basis in the year 1995 & 1997 and regularized vide letter No. SO(SE-IV)2-31/2004 dated 31.12.2004;                                                                                                                                                      ii  As per Notification No.FD;PC.2-1/83 dated 25.08.1983 issued y the Finance Department, PSTs, ESTs, ATS and SSTs were entitled  for advance increments. The Graduate English Teachers did not come under the purview of said Notification. However, vide notification N. SO(CONFDL:S) 1-13/90 dated  26-6-90 advance increments sanctioned by the Finance Department in para 15 of their notification No.FD.PC.2-1/83  dated 25.08.1983 were stopped.

         iii.   The Govt of the Punjab, Finance Department vide letter dated 03-11-2004 advised the Accountant General , Punjab that teachers who could not avail the benefit prior to 01-12-2001  due to any reason are not entitled for advance increment at this stage.

       iv. Prior to appointment and regularization of Graduate English Teachers, Finance Department vide letter No. FD.PR.12-5/84 (PT.II) dated 03-11-2004 had already stopped advance incements on attaining higher qualification.

       v.  The Govt of the Punjab, School Education department  vide notification No.SO(SE-III) 2-16/2007 dated 24-9-2007 approved higher  qualification allowance for Elementary School Teachers on acquiring higher qualification of M.A/M.Sc; and

     vi. The ESTs (English) are entitled for M.Phil Allowance at the rate of Rs.5000/- per month vide notification No.FD.SR-1/9-21/2011 dated 01-4-2013.

6.  The Department vide letter No. SO(SER-II) 7-241/2013 dated 31-10-2013 has requested the Finance Department to issued necessary advice on the judgment dated 23-09-2013 passed in write petition No.112369/2013.

7.  In view of the above, I, Secretary School Education hereby dispose of the petition of petitioners, Mr. Muhammad Shabbir , EST (English) Govt. Elementary School Ishaq  Wala Muzaffargarh and 04 others, subject to advice issued by the Finance Department.

Notification of Leave Encashment for 365 Days by Local Govt & Community Development Department

Govt of the Punjab, Local Govt & Community Development Department (ADMN-III SECTION) has issued Notification No. SO.ADMN.III(LG)1-36/2004(P) dated 27th November 2013 in connection with the Leave Encashment for 365 days instead of 180 days.

In this Notification with reference to the Notification No. FD-SR-II/2-141/2012 dated 09-09-2013 issued by the Finance Department Punjab,  it has been mentioned to adopt mutatis mutandis the grant of leave encashment of 365 days of civil employees of Punjab Government wef the 1st day of September 2013 to the employees of erstwhile local councils on the same terms and conditions as mentioned in the above said notification.

Here it is to mention that the Notification of Leave Encashment by Federal Government, in the same way Notification of Leave Encashment by Punjab Govt as well as Sindh Govt has already issued the Notification regarding Leave Encashment for 365 days instead of 180 days.

Up-Gradation of Deputy Accountants from BPS-14 to BPS-16-Decision of the Punjab Service Tribunal

The Punjab Service Tribunal Lahore has given its decision on 28th October 2013 in connection with the Up-Gradation of Deputy Accountants from BPS-14 to BPS-16. The comparative chart of the Federal Govt Employees and their counterparts in the Provincial Govt given in the grounds of appeals is as under:

The appellants possess the similar qualifications, nature of the duties performed are similar, work under the same roof and same officer. Similarly placed are to be treated similarly. No doubt the Punjab Govt works independently under the constitution but generally it follows the pay scales sanctioned by the Federal Govt.If two different pay scales are given to the Federal Govt Employees and the Provincial Govt Employees it may amount to extracting labour and exploitation under Article-3 of the Constitution of Islamic Republic of Pakistan. I tend to agree with the judgment of Lahore High Court 2004 PLC (CS) 586 that it is violation of the Article 2-A, 3, 25, 37 and 38 of the Constitution of Islamic Republic of Pakistan, 1973.

As far as the other two contentions of the respondents that the service structure will be affected and Govt of the Punjab will have to bear extra financial burden of Rs. 46.44 million, suffice to say that the service structure and financial constrains cannot stand in the way of Constitution. According to the chart placed on record by the appellants, respondent Provincial Govt will have to bear extra burden of Rs. 209,370/- whereas as per calculation of the respondent Finance Department the financial impact would be Rs. 46.44 million. This tribunal has no expertise in accounts that is not a big loss for the Provincial Govt. The law has to prevail. The up-gradations have already been made in Education Department, Police Department,, Excise & Taxation Department, Jail Department etc, there seems no reason that up-gradation should not be granted to the appellants.

In view of the above matter, all the appeals are accepted; impugned order dated 26-07-2012 is set aside. The appellants are declared to be entitled BPS-16.The Secretary Finance Department Punjab is directed to pass necessary orders in the light of the observations made above in order to remove the disparity/discrimination.

Notification of Minimum Wages Rates by Labour & Human Resource Department Punjab

Govt of the Punjab Labour & Human Resource Department has issued Notification No. SO (D-II)MW/2011(P-II) dated 4th September 2013 in connection with the Minimum Wages Rates.

The minimum rates of wages for adult unskilled and juvenile workers employed in any industry as under:

a-      Rs. 384.62/- per day (for eight working hours)

b-      Rs. 10000/-  per month (for twenty six working days)

The following reduction shall be followed from the wages of workers for providing housing accommodation and transport subject to agreement between the employer and the workers:

a-      For providing housing accommodation Rs. 150/- per month

b-      For providing transport  Rs. 30/- per month

Adult female workers shall get the same minimum wages as a male worker for work of equal value (vide Rule 15of the West Pakistan Minimum Wages Rules, 1962)

The daily/weekly working hours, condition of overtime work, work on weekly days of rest and paid holidays etc shall be regularized by the Finance Act 1934 (Act XXVI of 1934), Payment of Wages Act, 1936 (No. IV of 1936) and other relevant laws.

This Notification shall be effective with effect from 1st July 2013.

Govt of the Punjab School Education Department has issued Notification No. SO(S-VI)6-11/2012 dated 29th November 2013 in connection with the Move Over from BPS-19 to BPS-20 with effect from the dates mentioned against each.

Government of the Sindh, Education & Literacy Department has issued orders No. SO(G-II)1-27/2013 dated 3rd December 2013 in connection with the suspension from service PSTs/Teachers of District Mithi.

These teachers have been placed under suspension with direction to report to Education & Literacy Department Karachi with immediate effect and till further orders.

These teachers will get pay and allowances during suspension period as per rules.
